Welcome to DumaEats! We’re glad you’re here. These Terms & Conditions ("Terms") explain the rules for using our website, app, and services (together, the "Platform").
DumaEats is a food ordering and delivery platform that connects customers with participating restaurants, food businesses, and delivery providers. DumaEats may facilitate ordering, payment, delivery, customer support, promotions, and other related services. Unless expressly stated otherwise, DumaEats does not prepare, manufacture, or package the food offered by restaurants listed on the Platform.
By creating an account, browsing the Platform, or placing an order, you agree to these Terms. If you don’t agree, please don’t use our services.
1. How DumaEats Works
We connect you with local restaurants and delivery drivers. While we handle the technology, payments, and support, we do not cook or package the food — that is up to the restaurants.
2. Eligibility
To use DumaEats you need to be able to enter into a legal agreement and provide honest information. If you are a minor, you will need a parent or guardian’s permission.
3. Your Account
When you sign up, you are responsible for keeping your login information safe, and for everything that happens under your account. If you think someone else has accessed it, let us know right away. We may close accounts that provide false information or are used for fraud.
DumaEats may suspend, restrict, or terminate your access to the Platform where reasonably necessary, including if you:
- Breach these Terms.
- Engage in fraudulent or abusive conduct.
- Misuse promotions or refunds.
- Create a security risk.
- Use the Platform unlawfully.
4. Menus and Food Information
Restaurants are responsible for their own menus, prices, and allergy information. The photos you see are mostly for illustration and might not look exactly like the meal you receive. If an item is sold out, a restaurant might have to cancel that part of your order.
5. Placing an Order
When you tap "order", you are asking a restaurant to make food for you. The order is officially accepted once the restaurant confirms it. Sometimes we have to cancel orders due to issues such as being out of range, payment problems, or the restaurant being too busy.
6. Prices and Fees
The total you see before checkout includes the food price plus any delivery fees, service fees, and taxes. Prices can change, but once your order is accepted, your price is locked in.
7. Payment
By giving us your payment information, you confirm that you are authorised to use that card or wallet. We use secure third-party processors to handle your transactions, so we do not usually store your full card details ourselves.
8. Delivery
We do our best to be on time, but traffic, weather, and kitchen rushes can cause delays. Please make sure your address is right and that you are available to collect the food when it arrives. If we cannot find you or the address is wrong, you might still be charged.
9. Changes and Cancellations
Because kitchens start cooking quickly, you usually cannot change or cancel an order once it is submitted. If a cancellation is possible, we will let you know about any fees through the app.
10. Quality and Allergies
The restaurant is responsible for making sure your food is safe and high quality. If you have a serious allergy, please contact the restaurant directly to double-check their ingredients, as we cannot personally guarantee against cross-contamination.
11. If Something Goes Wrong
If your food is missing, wrong, or damaged, please tell us as soon as possible through our support channels. We will look into it and may offer a refund or credit, though we cannot guarantee a refund if the issue was caused by incorrect information you gave us.
12. Promotions and Credits
Promotions usually cannot be exchanged for cash, have expiration dates, and cannot be combined unless we say otherwise. If we find someone abusing the system, we will cancel those rewards.
13. Customer Conduct
We ask that you use the Platform fairly: no hacking, no fake accounts, and — most importantly — no harassing or abusing restaurant staff, delivery drivers, or our team. We have a zero-tolerance policy for abuse. You agree not to:
- Use DumaEats for unlawful or fraudulent purposes.
- Create multiple accounts to abuse promotions or rewards.
- Provide false or misleading information.
- Attempt to gain unauthorized access to the Platform.
- Interfere with the operation or security of DumaEats.
- Reverse engineer or improperly access Platform technology.
- Use automated systems to scrape, collect, or access Platform data without authorization.
- Harass, threaten, or abuse restaurant staff, delivery personnel, DumaEats employees, or other users.
- Submit fraudulent refund or complaint requests.
- Use the Platform in a manner that could damage DumaEats, restaurants, delivery providers, or other users.
14. Reviews and Photos
If you post a review or a photo, make sure it is honest and respectful. By sharing it, you give us permission to show it on our Platform to help other customers.
15. Ownership
Everything on the Platform — the logos, the code, the design — belongs to DumaEats. You are welcome to use the app for your personal use, but please do not copy or sell our material.
16. Third Parties
We work with other companies (such as Google Maps and payment processors) to make the app work. They have their own rules, and we are not responsible for things that are strictly under their control.
17. App Availability
We try to keep the app running 24/7, but sometimes we need to take it offline for maintenance or updates. We do not guarantee that it will be error-free at all times.
18. Disclaimers
We provide DumaEats "as is". While we try to be perfect, we do not promise that every restaurant will always be open or that every delivery will be exactly on time. Your standard consumer rights still apply.
19. Our Liability
To the extent the law allows, DumaEats is not responsible for major indirect losses or damages. If we are found liable for a mistake, our responsibility is usually limited to the amount you paid for that specific order.
20. Indemnity
If you violate these Terms, break the law, or misuse the app in a way that leads to a claim against us, you agree to cover the costs and damages that result from those actions.
21. Privacy
We care about your data. Please read our Privacy Policy to see how we handle your personal information.
22. Closing Your Account
We can stop your access to DumaEats if you break these rules or use the Platform for fraud. You can also stop using our services whenever you like.
23. Changes to These Terms
As we grow, we might update these rules. We will post the new version here with a new date. If you keep using the app after a change, it means you accept the new Terms.
24. Law and Disputes
These Terms are governed by local laws. If we have a disagreement we cannot resolve, it will be handled by the courts or dispute processes in your area.
25. Validity
If a court finds that one part of these Terms is not valid, the rest of the agreement still stands.
26. The Whole Agreement
These Terms, together with our other policies, are the full agreement between us regarding your use of DumaEats.
